In 2007, the Belgian authorities have adopted the reduction of taxes in relation to the patent application, reducing it from EUR 937 to EUR 350.

They keep at the moment this process of simplification while the procedure for obtaining a patent is being facilitated.

The conditions to obtain a date for the application will be softened and from now on, only the application the depot of the description of the invention will be necessary.

The successional transmission of the author moral right

The painter and sculptor Victor Vasarely has died on the 15th of March 1997.

On the 28th of November 1990, he has written his will pursuant to which his sun, Jean-Pierre, was declared being the sole legatee of the moral rights attached to its complete work.

His son has died in 2002 and has given these moral rights to his wife, Michèle.

However in a second testament dated 11 April 1993, the artist has amended its will and decided that all the quota lot will be transmitted to its grandson, Pierre.

He has also had that he wishes that his grandson takes care of the durability and the continuation of his work within the Vasarely Foundation.

The question to know who is the real legatee of the moral right attached to his work had to be defined by the jurisdictions.

The judges have estimated, in a judgment dated 5 November 2009, that the moral right is transmitted further to the successional rules, such rules which predict that only the last wills of the deceased should be taken into consideration and be looking for.

The tribunal de grande instance of Aix en Provence has precised that the grandson is understood pursuant to the will as the only one being able to provide this “durability” and this continuation of this work, apart from the fact that these last terms clearly and easily recall the exercise of the moral right on the work of the artist.

The judges have finally took a decision in favour of Pierre by considering that he will be the only holder of the moral right on all the work of his grandfather Victor Vasarely.

Applications for international brands registration also suffer from the crisis.

The Worldwide Office for Intellectual Property has announced that the financial crisis has affected, in 2009, applications for international brands registration in the framework of the Madrid System.(A single registration for the protection of a brand in various countries).

Even if increases have been noted, especially within the European Union, in Korea, in Singapore, Croatia, Hungary and other countries, the overall of applications has failed of 16% in 2009 in comparison to the year 2008.

This fall can be explained by the difficult economic context for the firms that are facing a significant decrease of the demands of the consumers.

The field of brands is directly concerned by the economic context. During crisis periods, firms usually develop fewer products. The number of brands to be protected is then directly affected.

However, the situation remains rather stable (-1,2%) for the renewal of registration of international brands which proves that owners of brands admit the necessity of such protection to keep existing in the world of consummation.

Whithout any surprise, the AFNIC has been renewed by the French government for the management of the extension .fr for a term of 7 years.

To obtain this renewal, the AFNIC should respect a number of commitments of openings of .fr extensions.

In a first step, and as from the 16th of March 2010, the .fr extension will be shortly opened to French residents abroad. The owner of a .fr extension will not have to justify anymore an address in France.

Then, within a delay of two years, the AFNIC will open the .fr to private individuals as well as to companies being on the territory of the European Union.

Thanks to these dispositions, France can hope to restrict the marginalization of .fr, and its presence on the future media, that the comparatives statistics at a worldwide level illustrate each year a little bit more.

World Extension of domain names.lu

Luxembourg: As from February 2010, it will not be necessary anymore to have a domicile or a registered office in Luxembourg in order to register and manage Luxembourg's domain names. The appointment of a mandatory, being established in Luxembourg, is not compulsory anymore.

The only restriction to this principle is to remain reachable at any time with an active email address.

The other major change is the opening of the extension .lu to the internationalized domain names (DIN).

A setting up of this period is fixed as from the 1th of February to the 31st of March 2010.

These internationalized domain names can be acquired, during this period, from an existing domain name by replacing a character by the same character containing a diacritical sign (ex: “a”: à, â,ä).

This domain name should be registered in the name of the same holder than the one of the pre-existent domain name.

The extension to all the domain names will be definitive from April 2010.
